Mapping of legal vulnerability of minors
In 188 cases opened to evict families between 2012 and 2013, the childhood taskforce Madrid´s Mortgage Victims Platform (PAH MADRID) – Enclave Consulting – Qiteria Consulting, provisionally recorded 392 children and adolescents at risk, lacking legal protection.
The map tells the situation of child and adolescent rights as regards to housing rights, seen from the perspective of an administration of justice that lacks protection of minors subjected to foreclosure procedures, whether for mortgages or other reasons.
The purpose of mapping this is to highlight a phenomenon hitherto unknown to serve the general interest of handling such information both visually and interactively.
According to the provisional data collected by PAH Madrid of cases handled in 2012 and 2013 examining the judicial processes of households with minors, the situation presented by the map above is as follows:
- Babies, children and adolescents present in 188 households involved in foreclosure proceedings or evictions.
- In those households live 392 babies, children and adolescents, an average of 2.08 per dwelling.
- Of these 392, some 110 are under 3 years old, that is to say 28.06% of the total.
- The remaining 282 are more than 3 years old, comprising 71.94% of the data collected provisionally.
The majority of the youngsters involved in the legal procedures and evictions are discriminated by the moratorium established by law 1/2013, known as the De Guindos law, for two fundamental reasons:
The law does not take into account children and adolescents between the ages of three and eighteen, a breach of one of the four basic principles of the Convention for the Rights of Children, that of No Discrimination.
The moratorium is not respected, not even when there are children under three years old.
- Only 32.44% of these households had legal aid.
- In all the cases shown on the map, no attention whatsoever has been provided by an attorney or lawyer specialized in children and adolescents.
To navigate on this map, designed with the help of the Citizen´s Initiative Incubator (Vivero de Iniciativas Ciudadanas) on the upper right is a window called visible layers. Clicking on it, some variables are displayed and you can choose to display how many you want.
If you click on each point you can obtain information such as: year, district, less than three years old, and minors.
To zoom in on the map, click on the plus or minus symbol in the upper left corner. The search can be either be refined or an overall idea of the situation in Madrid obtained.
