DECLARACIÓN DEL MINISTERIO DE RELACIONES EXTERIORES DE
CUBA
Estamos asistiendo a un nuevo golpe al multilateralismo y a las Naciones
Unidas. Estados Unidos ha amenazado con pedir votación y votar en
contra del proyecto de resolución presentado por el Presidente de la
Asamblea General de las Naciones Unidas el pasado jueves 23 de febrero,
con el objetivo de dejar establecidas las modalidades del Consejo de
Derechos Humanos, órgano que sustituiría a la actual CDH. Como se
conoce, dicha Comisión terminó hundida en el descrédito por la
manipulación política impuesta a sus labores por la Administración Bush y
sus aliados y cómplices de la Unión Europea.
El Embajador de Estados Unidos antes las Naciones Unidas - impuesto por
los halcones de la Casa Blanca a contrapelo del propio Congreso de la
Unión -, anunció ayer lunes 27 de febrero, que contaba con instrucciones
para reabrir las negociaciones con relación al texto del proyecto,
añadiendo que si se intentaba adoptar una decisión sobre el mismo en su
contenido actual, solicitaría votación y votaría en contra del mismo.
Lo paradójico en todo esto es que el proyecto de resolución, que fuera
circulado oficialmente hoy 28 de febrero, fue concebido minuciosamente y
negociado tras bambalinas con los personeros de Washington para
acomodar, precisamente, las principales exigencias de la superpotencia, a
sabiendas de que estas no contarían con el apoyo mayoritario de los
miembros de las Naciones Unidas.
Durante los meses transcurridos del proceso en curso, Estados Unidos y
sus aliados han ejercido fuertes presiones sobre numerosos gobiernos del
Tercer Mundo, con el objetivo de quebrar su resistencia frente a esta
nueva confabulación. La Misión de Cuba ante las Naciones Unidas
denunció el peligro de la consumación de esta maniobra en un
Comunicado de Prensa distribuido el pasado 20 de febrero.
El chantaje es el único "argumento" de la Administración Bush. Sus tesis
no resisten el debate. ¿Qué Consejo de Derechos Humanos pretende
imponer Estados Unidos?:
" Uno cuyos miembros queden sujetos a requisitos y
condicionamientos de tal naturaleza, que harían imposible el ingreso al
mismo de aquellos países que se coloquen en la primera línea de
resistencia frente a las acciones agresivas y hegemónicas del imperialismo
a escala global. Estados Unidos pretende hacer creer que el descrédito de
la CDH es el resultado de la presencia en la Comisión de países como
Cuba, cuando es bien conocido que, por el contrario, fueron las maniobras
políticamente motivadas que promovieron Washington y los miembros de la
Unión Europea, tales como el injusto ejercicio anticubano, las que dieron al
traste con la credibilidad de la Comisión. Recordemos que, incluso, Estados
Unidos no fue elegido para integrar la Comisión de Derechos Humanos en
el año 2001 como voto de castigo de la mayor parte del mundo ante sus
imposiciones y manipulaciones.
" Uno que vea disminuida la actual membresía de 53 miembros de la
Comisión de Derechos Humanos. Hablan de un órgano "más manejable",
es decir, uno más pequeño que les permita concentrar sus presiones sobre
menos miembros, para elevar el impacto de las mismas y hacerlas más
efectivas. En otras palabras, desean un Consejo que puedan "manejar"
mejor, sin la presencia de aquellos que, como Cuba, llamamos a las cosas
por su nombre y defendemos, por encima de todo, los principios y la
dignidad de los pueblos.
" Uno en el que se imponga a los países candidatos a integrarlo el
requisito de recibir el apoyo de dos tercios de los miembros de la Asamblea
General para tener éxito en su candidatura. De tal modo, pretenden
garantizarse en la práctica, con el acompañamiento cómplice de una clara
minoría conformada por sus aliados cercanos y aquellos que se subordinan
a sus dictados, el poder de vetar a los candidatos que obstruyan el control
que pretenden sobre los trabajos del órgano. La imposición de este
requisito, que sólo se aplica a la elección de los órganos principales de las
Naciones Unidas, lo cual no es el caso del Consejo de Derechos
Humanos, permitiría a una minoría de 64 Estados bloquear la candidatura
de cualquier aspirante.
" Uno que tenga amplios poderes punitivos y capacidad sancionadora
contra los países del Sur, en contraposición con la cooperación
internacional en materia de derechos humanos, función que la Carta de las
Naciones Unidas asigna a las instituciones que se ocupan de esta materia.
Tanto Estados Unidos como la Unión Europea seguirán adelante en el
nuevo órgano con sus tradicionales ejercicios de manipulación política
contra los pueblos en desarrollo. Por algo se niegan a considerar siquiera el
establecimiento de criterios claros y que se apliquen a todos por igual a la
hora de la presentación de resoluciones sobre países.
" Uno en el que los miembros al asumir una conducta disidente frente
a las maniobras e imposiciones del Imperio, quedarán sujetos al
permanente riesgo de ser suspendidos de sus derechos, por la soberbia, el
rencor y la arrogancia de la superpotencia.
" Uno que cuente con estrechos vínculos con el Consejo de
Seguridad, órgano antidemocrático al que Estados Unidos impone sus
condiciones como única superpotencia.
" Uno que no cuente con un mandato expreso para atender de modo
priorizado la realización del Derecho al Desarrollo, reivindicación vital de las
grandes mayorías de la especie humana. Uno que no pueda adoptar
decisiones efectivas contra el racismo, la discriminación racial, la xenofobia
y otras formas conexas de intolerancia. Uno que concentre sus trabajos en
los derechos civiles y políticos como los entiende Washington y que sirva,
además, entre otras cosas, para legitimar la tortura, a cuya justificación
tanto tiempo han dedicado los teóricos y halcones de Washington.
¿Resulta acaso el proyecto de resolución que ha sido registrado contrario a
los intereses de Washington? Todo lo contrario. El mismo consagra la
disminución del número de miembros del principal órgano de derechos
humanos de las Naciones Unidas, de 53 a 47 miembros; eleva el número
mínimo de votos requeridos para la elección de un candidato a 96;
mantiene la posibilidad de imponer resoluciones contra países del Sur, sin
sujeción o respeto a criterio alguno. Hace posible, además, la suspensión
de los miembros del Consejo con el apoyo de dos tercios de los presentes y
votantes en una reunión oficial de la Asamblea General, sin establecer un
límite mínimo requerido; abre la posibilidad de que los países del Sur
tengan que enfrentar en el futuro no sólo el peligro permanente de ser
condenados a través de una resolución, también de ser suspendidos de
sus derechos en el Consejo; le da la capacidad al Consejo de responder de
modo expedito a las llamadas emergencias de derechos humanos que,
según los pretendidos dueños del mundo, sólo ocurren en el Sur. Sin
embargo, no se aplica a las graves, masivas y sostenidas violaciones de
derechos humanos en el centro de detención de la base de Guantánamo,
las torturas brutales en Abu Ghraib o el traslado de detenidos para ser
torturados en vuelos secretos de la CIA a través de la civilizada y
democrática Europa; hace posible la celebración de reuniones
extraordinarias del Consejo a partir de la voluntad minoritaria de un tercio de
los miembros del Consejo.
¿Puede calificarse acaso el proyecto de resolución presentado por el
Presidente de la Asamblea como un texto que favorece los intereses de los
países en desarrollo, en detrimento de las apetencias de Washington? En
lo absoluto. De los 28 párrafos del proyecto, ni uno sólo fue destinado a
promover acciones concretas que permitan superar los obstáculos que
plantea el orden internacional vigente a la realización del objetivo de todos
los derechos humanos para todos, tal y como establece el artículo 28 de la
Declaración Universal de Derechos Humanos. No existe párrafo alguno
consagrado a plenitud a la promoción del Derecho al Desarrollo. No se
mencionan siquiera los derechos de solidaridad. El derecho de los pueblos
a la paz tampoco recibió en el proyecto de resolución el reconocimiento
universal que merece.
El problema fundamental no radica en que el texto de la resolución
presentada sea contrario, incompatible, o que tan simplemente no asegure
los intereses de estabilidad, credibilidad y legitimidad que requiere el
esquema de dominación global diseñado por los círculos imperialistas que
detentan el poder en Estados Unidos. La motivación real de la embestida
final de la actual Administración estadounidense en las negociaciones del
Consejo de Derechos Humanos, es evidenciar su voluntad y capacidad
para imponer, incluso con el más burdo chantaje, sus condiciones al
proceso en curso de reforma y rediseño del sistema internacional que las
Naciones Unidas representan. Los neoconservadores de la Administración
Bush han iniciado ya, y a marcha acelerada, el proceso de aplicación del
proyecto de dominación mundial que plantea el llamado Proyecto para un
Nuevo Siglo Americano.
No ha importado a Washington colocar a sus aliados y cómplices de la
Unión Europea nuevamente en el ridículo de la subordinación y el
acompañamiento mimético a la superpotencia. Después de haber
expresado públicamente que se aprestaban a forzar la adopción en el más
breve plazo de un proyecto de resolución concebido para acomodar las
impopulares demandas de Washington y sus propios intereses, tan espurios
como los de su severo tutor, tan pronto se hicieron públicas las
amenazantes declaraciones de Bolton, se han apresurado a indicar que si
Washington insiste en su posición, deberá posponerse la creación del
Consejo.
De este modo, ya varias autoridades de la Unión Europea han declarado
que "no es deseable un Consejo creado sin el apoyo de todas las
democracias del mundo, así que tenemos que tratar de llevar a EE.UU.
hacia nuestro campo".
Ya deben estar trabajando de modo vehemente los aliados europeos del
Imperio para arrancar al resto del mundo nuevas concesiones que permitan
saciar la sed de dominación y rapiña de la Administración Bush.
Al fin y al cabo, sus intereses ideológicos y políticos son los mismos que los
de Washington, que se ha encargado de hacerles comprender que sus
objetivos no podrían ser cumplidos en Ginebra sin el apoyo de Estados
Unidos.
Manipulando el interés universal del fortalecimiento del multilateralismo,
Washington, sus aliados y otros gobiernos vulnerables a las presiones de
Estados Unidos, pretenden seguir imponiendo sus condiciones obligando al
resto de las naciones a claudicar en la imprescindible defensa de los
principios centrales del sistema internacional.
El multilateralismo sólo puede funcionar sobre la base del respeto a la
igualdad soberana de los Estados. No serían viables unas Naciones
Unidas que permitan a la superpotencia actuar a su antojo en la
instrumentación de sus apetencias hegemónicas e intereses egoístas.
Cuba ha venido participando activamente en los debates sobre la reforma
de la CDH con un espíritu constructivo y total transparencia. Ha
presentado numerosas propuestas en las sucesivas etapas del proceso,
muchas de ellas sustentadas en lenguaje previamente acordado en la
Conferencia Mundial sobre los Derechos Humanos, que tuvo lugar en
Viena en el año 1993, o en sucesivas resoluciones de la Comisión de
Derechos Humanos y la Asamblea General.
Cuba seguirá trabajando para que aquellos aspectos que fueron dejados a
un lado de modo injusto, y en contra de la voluntad de la mayoría de los
Estados del Sur, sean debidamente incluidos en el proyecto de resolución
sobre el que deberá pronunciarse la Asamblea General. Esas omisiones
atentan gravemente contra la posibilidad de asegurar la creación de un
Consejo de Derechos Humanos que sustente sus labores en el diálogo
genuino.
Cuba ha trabajado arduamente por evitar que se transfieran al nuevo
órgano los graves problemas que dieron al traste con la credibilidad de la
CDH. Nuestro país no será cómplice de la consumación silenciosa de una
nueva componenda en ciernes entre Washington y sus principales aliados
occidentales contra los intereses de los pueblos del Sur.
Cuba mantendrá su denuncia vertical frente a este nuevo ataque al
sistema internacional y a los intereses de los pueblos del Sur y actuará,
según las circunstancias lo exijan, en defensa de la justicia, del Derecho
Internacional y de la tan necesaria cooperación internacional a favor de la
promoción y protección de todos los derechos humanos para todos los
pueblos y todas las personas.

STATEMENT BY THE MINISTRY OF FOREIGN AFFAIRS OF THE
REPUBLIC OF CUBA
We are bearing witness to a new blow to multilateralism and to the United
Nations. The United States is threatening with calling for a vote and voting
against the draft resolution presented by the President of the General
Assembly of the United Nations last February 23, with the aim of
establishing the modalities of the Human Rights Council, body which will
substitute the current Commission on Human Rights. As it is known, said
Commission went to pieces due to the political manipulation imposed to its
works by the Bush Administration and its allies and accomplices of the
European Union.
The United States Ambassador to the United Nations - imposed by the
hawks of the White House against the Union's Congress itself - ,
announced yesterday Monday, February 27, that he had received
instructions to reopen the negotiations in regard to the draft, adding that if
there were attempts to adopt a decision on it in its current content, he
would request the vote and vote against it himself.
What is paradoxical in all this is that the draft resolution, officially
circulated
today February 28, was meticulously conceived and negotiated behind the
scenes with Washington's representatives to accommodate, precisely, the
main demands of the superpower, knowing that these would not have the
majority support of the members of the United Nations.
During the months that have passed of the current process, the United
States and its allies have exerted strong pressures on the numerous Third
World governments aimed at breaking their resistance to this new
confabulation. The Mission of Cuba to the United Nations denounced the
danger of the perpetration of this ploy in a Press Release distributed last
February 20.
Blackmail is the only "argument" of the Bush Administration. Its thesis
cannot withstand debate. What kind of a Human Rights Council is the
United States trying to impose?
- One in which its members are subjected to requirements and
conditionings of such a nature, that they would make impossible for the
countries that place themselves in the front line of resistance against the
aggressive and hegemonic actions of the empire at a global level to join it.
The United States is trying to make believe that the discredit of the CHR is
the consequence of the presence of countries like Cuba in the Commission,
when it is well known that, on the contrary, it was the politically motivated
maneuvers promoted by Washington and the European Union, such as the
unjust anti-Cuban exercise, which put paid to the Commission's credibility.
Let us recall that, additionally, the United States was not elected to make
up the Commission on Human Rights in the year 2001, voted out by the
majority of the world for its impositions and manipulations.
- One which suffers a reduction of its membership to the current 53
members of the Commission on Human Rights. They talk about a "more
manageable" body, that is, a smaller one which allow them to concentrate
their pressures on less members, to increase their impact and make them
more effective. In other words, they want a Council which they can
"manage" better, without the presence of those who like Cuba, call things
by their names and defend, above all, the principles and dignity of the
peoples.
- One in which the requirement of receiving the support of two
thirds of the members of the General Assembly is imposed to the candidate
countries in order to succeed in their candidature. In this way, they hope to
guarantee for themselves in the practice - with the conspiratorial support of
a clear minority made up by their close allies and those who subordinate to
their dictates - the power to veto the candidates which hinder the control
that they intend to gain on the body's works. The imposition of this
requirement, which is only applied to the election of the principal organs of
the United Nations, which is not the case of the Human Rights Council,
would allow a minority of 64 States to block the candidature of any aspirant.
- One with ample punitive powers and sanctioning capacity
against the countries of the South, as opposed to the international
cooperation in human rights matters, function assigned by the Charter of the
United Nations to the entities in charge of this issue. Both the United States
and the European Union will go ahead in the new body with their traditional
exercises of political manipulation against the developing countries. No
wonder they refuse to even consider the establishment of clear criteria
applied to all by equal at the moment of presenting resolutions on countries.
- One in which the members, in assuming a dissident position
before the Empire's ploys and impositions, will be subjected to the
permanent risk of being suspended their rights, on account of the pride,
rancor and arrogance of the superpower.
- One that has close ties with the Security Council, antidemocratic
body which the United States imposes its conditions on as the only
superpower.
- One that does not have an express mandate to carry out in a
prioritized manner the realization of the Right to Development, key demand
by the great majority of the humankind. One that cannot adopt effective
decisions against racism, racial discrimination, xenophobia and other forms
of related intolerance. One that focus its works on the civil and political
rights as understood by Washington and that serves, among other things,
to legitimate torture, which the theoreticians and hawks of Washington
have devoted so much time to justify.
Is it possible that the draft resolution is contrary to the interests of
Washington? All the contrary. It endorses the decrease of the number of
members of the main body of human rights of the United Nations, from 53 to
47 members; increases the minimum required votes to elect a candidate to
96; maintains the possibility to impose resolutions against countries of the
South, without respecting any criteria. It also makes possible the
suspension of the members of the Council with the support of two thirds of
the members present and voting in an official meeting of the General
Assembly, without establishing a minimum required limit; it opens the
possibility for countries of the South in the future, to face the permanent
danger of being condemned through a resolution, and also, to be deprived
from their rights in the Council; it makes possible for the Council to respond
in an expeditious way to the so called human rights emergencies that,
according to the self appointed masters of the world, only take place in the
South. However, these provisions will not apply to the grave, massive and
sustained violations of the human rights at the detention center of
Guantanamo base, the brutal tortures at Abu Ghraib or the transfer of
detainees to be tortured in secret flights of the CIA through the civilized and
democratic Europe; it makes possible for extraordinary meetings of the
Council to be held, based on the minority will of one third of the members of
the Council.
Is there any possibility to describe the draft resolution submitted by the
President of the General Assembly as a text that favors the interests of
developing countries, to the detriment of the interests of Washington?
Absolutely not. Out of the 28 paragraphs of the draft, not even one was
aimed at promoting concrete actions to overcome the obstacles created by
the current international order to the realization of the objective of human
rights for all, as it is established by article 28 of the Universal Declaration
of
Human Rights. There is no paragraph completely devoted to the promotion
of the Right to Development. Right to solidarity is not even mentioned. The
right of peoples to peace did not get the universal recognition that it
deserves in the draft resolution.
The main problem is not that the draft resolution is contrary, incompatible, or
that it simply does not guarantee the stability, credibility and legitimacy
interests required by the plan of global domination designed by the
imperialist circles that hold the power in the United States. The real
motivation for the final onslaught of the current Administration of the United
States in the negotiations of the Human Rights Council is to show its will
and capability to impose, even through the use of blatant blackmail, its
conditions to the ongoing reform and reshaping of the international system
represented by the United Nations. The neo-conservatives of the Bush
administration have already initiated, at top speed, the process of
implementation of the project of global domination expressed in the so
called Project for the New American Century.
Washington has not cared about putting their allies and accomplices of the
European Union, once more, in the ridiculous position of subordination and
mimetic support to the superpower. After having expressed publicly that
they were going to force the adoption, in the shortest term, of a draft
resolution designed to accommodate the unpopular demands by
Washington and its own interests, as spurious as those of its severe tutor,
as soon as Bolton's threatening statements came to the fore., they have
rushed to indicate that if Washington insists in its position, the creation of
the Council should be postponed.
In this way, many authorities of the European Union have already declared
that "it is not desirable to create a Council without the support of all the
democracies of the world; therefore we have to try to attract the United
States to our side."
The European allies of the Empire should be already working really hard to
try to get from the rest of the world new concessions to quench the thirst of
domination and pillage of the Bush administration.
In the end, their politic and ideological interests are the same as those of
Washington, which made them understand that their goals in Geneva could
not be fulfilled without the support of the United States.
Manipulating the universal interest of strengthening multilateralism,
Washington, its allies and other governments vulnerable to the pressures of
the United States, intend to keep on imposing their conditions compelling
the rest of the nations to give in to the indispensable defense of the central
principles of the international system.
Multilateralism can only work on the basis of respect to the equal
sovereignty of the States. A United Nations Organization that allows the
superpower to act at its will in the implementation of its hegemonic appetite
and selfish interests would not be feasible.
Cuba has been actively participating in the debates on the reform of the
Commission on Human Rights with a constructive spirit and total
transparency. It has submitted numerous proposals in the successive
stages of the process, many of which are based on the language previously
agreed upon in the World Conference on Human Rights, held in Vienna in
1993, or in successive resolutions of the Commission on Human Rights and
the General Assembly.
Cuba will continue working so as those aspects that were disregarded
unjustly and against the will of the majority of the States of the South, be
duly included in the draft resolution on which the General Assembly should
make a statement. Those omissions are a serious attempt against the
possibility of ensuring the creation of a Human Rights Council that bases its
works on genuine dialogue.
Cuba has worked arduously to prevent that the problems that put paid to
the credibility of the CHR from being transferred to the new body. Our
country will not be accomplice to the silent perpetration of a new plot in the
making between Washington and its main western allies against the
countries of the South.
Cuba will keep its vertical denounce against this new attack to the
international system and to the interests of the countries of the South, and
will act, in accordance to the circumstances, in defense of justice,
International Law and the so necessary international cooperation in favor of
promoting and protecting all the human rights for all the peoples and
individuals.
